Draft. This document is a reasonable starting point for a Florida nonprofit accepting online donations via Stripe. It has not been reviewed by counsel. Before the Foundation begins public solicitation, a Florida-licensed attorney must redline these terms.
Welcome to the STEMania Foundation. These Terms of Service ("Terms") govern your use of stemania.org and any donation, sponsorship, or fundraising activity conducted through it, as well as the role-gated Foundation apps at admin.stemania.org, board.stemania.org, and franchise.stemania.org. By using the site, signing in to a role-gated app, or making a donation, you agree to these Terms.
1. About us
STEMania Foundation is a Florida nonprofit corporation (EIN 33-3511828). The Foundation is a separate legal entity from STEMania, the for-profit STEM education platform operated at stemania.com.
2. Donations
All donations are final. Because donations are recorded in our ledger and reflected in contemporaneous tax receipts, donations are non-refundable except in cases of duplicate charges, demonstrable error, or fraud. If you believe your donation was charged in error, email curtis@stemania.org within 30 days.
Tax deductibility. The Foundation is a recognized 501(c)(3) public charity (IRS determination letter dated May 4, 2026; tax-exempt status effective August 20, 2025). Your donation is tax-deductible to the extent permitted by law. We will issue a contemporaneous written acknowledgment consistent with IRS Publication 1771. Please consult your tax advisor for advice specific to your situation.
Quid-pro-quo / FMV sponsorships. If you receive goods or services in return for your contribution (for example, an FMV-priced sponsorship that covers event attendance), only the portion of your contribution that exceeds the fair market value of what you received is tax-deductible. The acknowledgment we send will state the fair market value.
Designations. You may designate your gift as foundation-wide, to a specific franchise, or to a specific location. The Foundation honors donor designations consistent with Florida law; if a designation becomes impossible or impractical to honor, we will contact you to discuss redirection before using the funds for a different purpose.
Recurring donations. If you set up a recurring gift, it will continue on the schedule you selected until you cancel. You may cancel at any time by replying to any receipt email, by emailing curtis@stemania.org, or by using the unsubscribe link in our correspondence.
3. Fundraising campaigns
From time to time, STEMania franchise owners may run fundraising campaigns earmarked for their franchise. Donations made through a campaign landing page are credited to that franchise's designated fund. Campaign goals, descriptions, and imagery are the responsibility of the campaign organizer, subject to our review. The Foundation retains ultimate control over all funds and their use, consistent with our charitable purpose and donor intent.
4. Matching gifts
If your employer offers a matching-gift program, you may initiate a match through our matching-gift lookup. Matching gifts are separate contributions from your employer and are acknowledged to the employer as the donor of record, consistent with IRS guidance.
5. Role-gated app access
The Foundation operates internal apps at admin.stemania.org (Foundation Admin), board.stemania.org (Foundation Board, read-only), and franchise.stemania.org (Foundation Franchise). Access is by invitation and role assignment only. Using an account in a role for which you have not been authorized, attempting to access data outside your assigned franchise scope, or sharing credentials violates these Terms. Foundation staff approve funding requests and invoices at cost (not retail); franchise users who submit false, misleading, or fraudulent funding requests or invoices forfeit access and may be referred to appropriate authorities.
6. Acceptable use
You agree not to:
- Provide false, misleading, or stolen payment information
- Submit false, misleading, or fraudulent information on donation forms, funding requests, invoices, or campaign pages
- Attempt to disrupt, probe, or circumvent site security
- Use the site to send unsolicited communications or advertising
- Misrepresent your identity, employment, or charitable intentions
- Violate any applicable law or regulation
7. Intellectual property
The STEMania Foundation name, logo, site content, and publications are owned by the Foundation. You may share and link to our pages in a manner consistent with normal, non-commercial use. Any other use requires our written permission.
8. Disclaimers and limitation of liability
The site is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied. To the fullest extent permitted by law, the Foundation is not liable for indirect, incidental, consequential, or punitive damages arising from your use of the site or your donation.
9. Governing law and venue
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. Any dispute arising from these Terms or your use of the site shall be brought in the state or federal courts located in Sarasota County, Florida, and you consent to the personal jurisdiction of those courts.
10. Changes
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top. Your continued use of the site after an update constitutes acceptance of the updated Terms.
